1. Agreement to These Terms

These SMS Messaging Terms & Conditions ("Terms") govern your participation in text message (SMS/MMS) communications sent by Jersey City Police Activities League ("JCPAL," "we," "us," or "our").

By opting in to receive text messages from JCPAL — whether through our website chat widget, an online registration or contact form, or any other opt-in method — you agree to these Terms. If you do not agree, do not opt in to our SMS program.

2. Program Description

JCPAL operates an SMS messaging program to communicate with parents and guardians of current and prospective youth program participants. Messages may include:

Program reminders and schedule updates
Emergency notices and urgent safety alerts
Program announcements and important operational updates
Event information and activity details
Registration reminders and enrollment information

This program is operated by JCPAL directly. Message content is limited to informational communications related to JCPAL youth programs and services.

3. How to Opt In

You may opt in to receive SMS messages from JCPAL through one of the following methods:

Submitting your mobile phone number through the JCPAL website chat widget at www.thejcpal.org
Completing a registration or contact form on our website
Providing written consent through an in-person registration form

By providing your mobile phone number and consenting to receive text messages, you confirm that:

You are the account holder or have authorization to use the mobile number provided
You are 18 years of age or older (all program registrations on behalf of minors are handled by parents or legal guardians)
You consent to receive recurring automated text messages from JCPAL at the number provided

4. Message Frequency

Message frequency will vary based on program activity, upcoming events, and any emergency notifications. You may receive multiple messages per week during active program periods. JCPAL will only send messages that are relevant to your child's participation or JCPAL programs.

5. Message & Data Rates

Standard message and data rates may apply to all SMS messages sent and received. These rates are determined by your mobile carrier and your individual data plan. JCPAL does not charge any additional fees for participation in its SMS program.

Please contact your mobile carrier if you have questions about your messaging plan or applicable rates.

6. How to Opt Out (STOP)

You may opt out of JCPAL SMS communications at any time by replying STOP to any text message you receive from us.

After sending STOP, you will receive one final confirmation message acknowledging your opt-out. No further messages will be sent to your number, except as required by applicable law or carrier regulations.

Please note: Opting out of SMS messages does not affect your child's program enrollment or your account with JCPAL. You may continue to receive communications via email or phone.

To opt back in after opting out, reply START or contact us directly.

8. Supported Carriers

JCPAL's SMS program is supported by most major U.S. wireless carriers, including but not limited to:

AT&T
Verizon
T-Mobile
Metro by T-Mobile
Cricket Wireless
US Cellular
Boost Mobile

Carrier support is not guaranteed for all mobile carriers or devices. JCPAL is not responsible for any delays or failures in SMS delivery caused by your carrier or device.

9. No Sharing of SMS Opt-In Data

JCPAL will not sell, rent, share, or disclose your mobile phone number or SMS opt-in consent information to third parties for marketing or promotional purposes.

Your mobile number may be shared only with our SMS platform provider and communications technology vendor (HighLevel) solely for the purpose of delivering JCPAL messages to you. These vendors are contractually prohibited from using your information for any other purpose.

10. Privacy

Your use of JCPAL's SMS program is also governed by our Privacy Policy, available at www.thejcpal.org. The Privacy Policy describes how we collect, use, and protect your personal information, including information related to SMS communications.

11. Children's Privacy

JCPAL's SMS program is intended for parents and legal guardians only. We do not send SMS messages to minors, and we do not knowingly collect mobile phone numbers from individuals under the age of 18. If you believe a minor has opted in to our SMS program, please contact us immediately at info@thejcpal.org.

12. Prohibited Uses

You agree not to use JCPAL's SMS communications in any way that:

Violates any applicable federal, state, or local law or regulation
Infringes on the rights of any third party
Involves the use of automated tools or scripts to interact with our SMS program
Involves forwarding or distributing JCPAL messages without authorization

JCPAL reserves the right to remove any individual from its SMS program at its sole discretion.

13. Limitation of Liability

JCPAL's SMS messaging service is provided on an 'as is' and 'as available' basis. JCPAL makes no warranties, express or implied, regarding the reliability, accuracy, timeliness, or availability of SMS communications.

To the fullest extent permitted by law, JCPAL shall not be liable for any indirect, incidental, special, or consequential damages arising from your participation in our SMS program, including but not limited to delays, errors, or failures in message delivery.

14. Changes to These Terms

JCPAL reserves the right to update or modify these Terms at any time. When changes are made, we will update the "Last Updated" date at the top of this document. Your continued participation in our SMS program after changes are posted constitutes acceptance of the updated Terms.

If we make material changes to how we operate our SMS program, we will notify you via text message or email.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Any disputes arising from these Terms or JCPAL's SMS program shall be resolved in the appropriate courts located in Hudson County, New Jersey.
